These Terms of Service (“Terms”) describe our commitments to you, and your rights and responsibilities when using our services. These Terms govern your access to and use of the services we provide through untitledjob.com. Please read these Terms carefully before registering, accessing or using our Services. By accessing or using any part of our Services, you agree to be bound by all of the Terms and all other operating rules, policies, and procedures set forth on this website. You also agree that we may automatically change, update, or add on to our Terms or Services, and this agreement will apply to any changes.
“You” means any individual or entity using our Services. If you use our Services on behalf of another person or entity, you represent and warrant that you’re authorized to accept the Agreement on that person’s or entity’s behalf, that by using our Services you’re accepting the Agreement on behalf of that person or entity, and that if you, or that person or entity, violates the Agreement, you and that person or entity agree to be responsible to us.
"We", "Us", "Our" refers to Untitled Job. We are registered in Ontario Canada as 2200946 Ontario Inc. We are located at 2212 Lakeshore Blvd East Unit 3008, Toronto, Ontario, Canada.
You cannot use this site or services provided by us if you do not agree to our terms.
Our "Service" is to provide you photo retouching services of user provided content. Part of our services is our website untitledjob.com which provides functionality for you to upload photos, store photos, provide instructions, and download edited photos.
Your Responsibilies
1. Privacy
You agree to our Privacy Policy, which explains what we collect, how we use and protect the personal data you provide to us.
2. Registration
You must open an account using your email, full name, and password in order to access our Services. You are fully responsible for all activity that happens under your account. Users cannot have multiple accounts to abuse promotions or to circumvent bans.

4. Revision Policy
We offer revisions until you are satisfied with your order. However, the revisions must be reasonable and any extra requests that were not in the original instructions may be subject to additional costs. We reserve the right to cease working on revisions if we feel the requests are unreasonable. You have 14 days to request a revision beginning from the time we deliver the edited photo. If no revision is a requested in that timeframe, we consider you satisfied and the order is complete and closed.
5. Account Security and Liability
You, and those authorized by you, are solely responsible and liable for all activity under your account. You’re also fully responsible for maintaining the security of your account which includes keeping your password secure. We’re not liable for any acts or omissions by you, including any damages of any kind incurred as a result of your acts or omissions. Notify us immediately of any unauthorized uses of your account, or of any other breach of security. If we believe your account has been compromised, we may suspend or disable it.
6. Communications
You consent to receive email communications from us related to your registration, order details, important changes to the services, terms of service, and our privacy policy.
7. Payments
Our payment processing is done thru the industry standard payment provider Stripe. By making a payment you agree to Stripe's privacy and terms https://stripe.com/en-ca/privacy. You must deal directly with stripe for disputes and we will assist in any way we can.
8. Account Deactivation
You may end your business with us at any point by deactivating your account. This can be done under 'Account Profile'. You acknowledge and agree that if we disable access to your account, you may be prevented from accessing the Service, your account details or any files or other materials which is contained in your account. We may also terminate your access to all or any part of our Services at any time, with or without cause, with or without notice, effective immediately.
9. Indemnification
You agree to indemnify and hold Untitled Job and its parents, subsidiaries, affiliates, officers, employees, agents, partners and licensors (if any) harmless from any claim or demand, including reasonable attorneys' fees, due to or arising out of your: (a) use of the website; (b) violation of this Agreement or any law or regulation; or (c) violation of any right of a third party.
10. Submissions and Privacy
In the event that you submit or post any ideas, creative suggestions, designs, photographs, information, advertisements, data or proposals, including ideas for new or improved products, services, features, technologies or promotions, you expressly agree that such submissions will automatically be treated as non-confidential and non-proprietary and will become the sole property of Untitled Job without any compensation or credit to you whatsoever. We shall have no obligations with respect to such submissions or posts and may use the ideas contained in such submissions or posts for any purposes in any medium in perpetuity, including, but not limited to, developing, manufacturing, and marketing products and services using such ideas.
Our Responsibilies
1. Privacy
Outlined in our Privacy Policy in accordance with the Personal Information Protection and Electronic Documents Act of Canada, we explain what we collect, and how we use and protect the personal data you provide to us.
2. Security
We have implemented layers of security features designed to keep your personal data safe from unauthorized access and accidental loss. However, we cannot guarantee these measures will never be defeated by an unauthorized party.
3. Site Access
Untitled Job reserves the right to modify, suspend or discontinue, temporarily or permanently, the website or any service to which it connects, with or without notice and without liability to you.
We do not guarantee our website and services will be running and available uninterupted at all times. In the event our website is temporarily unavailable at any time period, we will do our best to get your images to you by email or other means necessary in the timeframe quoted to you. We will not be held liable if we do not get your order to you in time.
4. Updates to Our website
We may from time to time provide enhancements or improvements to the features/ functionality of the website, which may include patches, bug fixes, updates, upgrades and other modifications ("Updates").
Updates may modify or delete certain features and/or functionalities of the website. You agree that Untitled Job has no obligation to (i) provide any Updates, or (ii) continue to provide or enable any particular features and/or functionalities of the website to you.
You further agree that all Updates will be (i) deemed to constitute an integral part of the website, and (ii) subject to the terms and conditions of this Agreement.
5. Typographical Errors
In the event a product and/or service is listed at an incorrect price or with incorrect information due to typographical error, we shall have the right to refuse or cancel any orders placed for the product and/or service listed at the incorrect price. We shall have the right to refuse or cancel any such order whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, we shall immediately issue a credit to your credit card account or other payment account in the amount of the charge.
6. Copyright Infringement Notice
If you are a copyright owner or such owner’s agent and believe any material on our website constitutes an infringement on your copyright, please contact us setting forth the following information: (a) a physical or electronic signature of the copyright owner or a person authorized to act on his behalf; (b) identification of the material that is claimed to be infringing; (c) your contact information, including your address, telephone number, and an email; (d) a statement by you that you have a good faith belief that use of the material is not authorized by the copyright owners; and (e) the a statement that the information in the notification is accurate, and, under penalty of perjury you are authorized to act on behalf of the owner.
7. Limitation of Liability
Notwithstanding any damages that you might incur, the entire liability of Untitled Job and your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by you for the Services.
To the maximum extent permitted by applicable law, in no event shall Untitled Job be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, for loss of data or other information, for business interruption, for loss of privacy arising out of or in any way related to the use of or inability to use the website, third-party software and/or third-party hardware used with the website, or otherwise in connection with any provision of this Agreement), even if Untitled Job has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.
Some states/jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
